Doramate Promotion – Terms and Conditions

  1. Information on how to enter and prizes form part of these terms and conditions (“Terms“). Participation in this promotion (“competition”) is deemed acceptance of these Terms.
  2. Entry in the competition opens at 6.00AM (AEDT) on Monday 1st July 2019 and closes at 11.59PM on Monday 30th September 2019 (“Promotional Period”).
  3. To enter and be eligible to win, entries and entrants must make a qualifying purchase and follow all instructions stated in the Online Entry form and under these Terms. By entering this competition, the entrants represent that they are eligible entrants.
  4. Entry is open to all Australian residents 18 years of age or over at the time of entry, excluding all employees of the Promoter and related entities, agencies, contractors, service providers, prize suppliers and/or retailers associated with this competition, including relatives of such persons. Winners will be required to verify their purchase, identity, place of residence and date of birth at the time of claiming a prize as well as satisfying the Promoter that the winner’s entry has complied with these Terms, which will be determined at the absolute discretion of the Promoter.
  5. Entrants can enter online at the Promoter’s product website (www.doramate.com.au) by submitting their details through the competition registration form during the Promotional Period. Only one entry per person is permitted. Entrants who enter more than once will be regarded as having entered once only. Entrants can only enter the competition in their own name.
  6. Incomplete, illegible, indecipherable or incorrect entries, or entries containing offensive or defamatory comments, or entries that breach any law or infringe any third-party rights (including intellectual property rights) are invalid.
  7. The competition is a game of chance. Winners will be determined by a computerised draw, which will draw two (2) eligible entries. The draw will take place at 2.00PM (AEST) on Friday 4th October 2019, at Troy Laboratories Australia PTY Limited, 35 Glendenning Road, Glendenning NSW 2761. There will be a total of two (2) winners of this competition.
  8. The prize details are outlined below:
    1. First draw prize is a Beefmaster 6 Burner BBQ (“First Prize”).
    1. Second draw prize is a Husqvarna Chain Saw (“Second Prize”)

The maximum prize pool is valued at AUD$1,800.00.

  • The Store where the entrant purchased the Promoter’s product will notify the winners by email and phone within four (4) business days of the draw (on or before Wednesday 8th October 2019). The name of the winners will also be published on the Promoter’s website (www.troylab.com.au) within four (4) business days of the draw (on or before Wednesday 8th October 2019), for a period not less than 28 days.
  • By entering this competition, entrants authorise and consent to the Promoter publishing their identity and relevant information on its website and any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  • Prizes (First Prize and Second Prize) will be available for collection, to the winners in accordance with these Terms within 28 days of the draw (on or before Friday 1st November 2019) from the store the purchase of the Promoter’s product was made, subject to the winners’ identity being verified in accordance with these Terms. Prizes are not transferable or exchangeable and all other costs associated with the prize including but not limited to travel, are the responsibility of the winner.
  • In the event that either the First Prize and/or the Second Prize are not redeemed within three (3) months of the draw, or a winner cannot verify its eligibility in accordance with these Terms, the Promoter will at its sole discretion conduct a computerised re-draw on Monday 4th November 2019 at Troy Laboratories Australia PTY Limited, 35 Glendenning Road, Glendenning NSW 2761, subject to approval by state regulations (“Re-Draw“). The winner(s) of the Re-Draw will be notified in accordance with clause 9 herein on or before Friday 6th December 2019.
  • All decisions made by the Promoter in relation to all aspects of this competition are final and binding. The Promoter will not be required to enter into any subsequent correspondence or discussion in relation to the decisions made in relation to this competition.
  • The use of any automated entry software or any mechanical, electronic or other means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  • Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) assumes no liability (including negligence) for any personal injury, loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the competition, including, but not limited to the following: (a) any entries not received for any reason during the Promotional Period (entries will be deemed accepted at the time of receipt by the Promoter); (b) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control) with the entry mechanism; (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason; (e) any variation in prize value to that value specified in these Terms; (f) any tax liability incurred by a winner or entrant; (g) redemption of a prize and/or (h) participation in the competition.
  • All costs associated or arising relating to participating in the competition are the responsibility of the entrants. Any costs associated with accessing the internet are the entrants’ responsibility.
  • It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
  • The Promoter reserves the right to publish and/or promote on the Promoter’s website, social media websites or platforms and/or blog and/or media, relevant details regarding the identity of the winners, including which State/Territory they reside in and details on how they may have benefited from the prize and may include photographs of the winners.
  • The Promoter collects, and the entrants consent to, the entrants’ personal information being collected and used for the purpose of conducting this competition and, for the same purpose, disclosing such personal information to third parties, including, without limitation, the Promoter’s related entities, agents, contractors, service providers, prize suppliers and/or Australia regulatory authorities. Entry is subject to requested information being provided. Without limitation, the Promotor collects personal information for the following purposes:
    • conducting the competition;
    • contacting the entrant in relation to the competition;
    • publishing the winner’s names and State / Territory of residence in accordance with these Terms and as required under relevant legislation;
    • improving the Promoter’s or the Promoter’s related entities’ goods and services; and
    • in the Promoter’s and its agencies’ case, the purposes set out in the Promoter’s privacy policy (https://www.troylab.com.au/privacy-policy).
  • Each entrant provides this consent until such a time as they withdraw their consent by giving notice to the Promoter. Entrants can also gain access to, update or correct any personal information held by the Promoter by contacting the Promoter directly in accordance with these Terms. The Promoter’s privacy policy (https://www.troylab.com.au/privacy-policy) also contains information about how eligible entrants can make a complaint. All personal information will be stored at the office of the Promoter.
  • The winners may be featured on the Promoter’s website, social media websites, blog or other relevant media platform. The prize is subject to the winners providing any photographs of and/or information requested by the Promoter regarding how they may have benefited from the redeemed prize for the purpose of promotion on its website, social media websites, blog or other relevant media platform. Decisions on the inclusion of any such features (including but not limited to creative control and date of inclusion) will remain at the complete discretion of the Promoter.
  • By entering the competition and providing an email address, the entrants thereby agree and consent to receiving future emails relating to the Promoter’s publications, products, services and events.
  • If for any reason this competition becomes incapable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to take any reasonable action that may be available, and to cancel, terminate, modify or suspend the competition, subject to written approval by state regulatory authorities.
  • Notwithstanding anything in these Terms, the Promoter reserves the right, at any time, to verify the validity of entries and entrants (including, without limitation, an entrant’s identity, place of residence and date of birth) and to disqualify any entrant who tampers or interferes with the entry process or otherwise does not comply with these Terms. Failure by the Promoter at any given time to enforce any of its rights does not constitute a waiver of those rights. Errors and omissions will be accepted at the sole and absolute discretion of the Promoter.
